AI is no longer a future concept for law firms. It is here now, and it is changing how lawyers find information, draft documents, review contracts, and manage their workload. For firms on NetDocuments, there are two major AI capabilities to understand: the built-in ndMAX Legal AI Assistant with Smart Answers, and external AI tools like Anthropic’s Claude that connect securely to NetDocuments through the Model Context Protocol (MCP).
This guide explains what each of these tools does, how they handle your data, and what the practical differences are between using AI with and without a secure connection to your document management system.
ndMAX: AI Built Into NetDocuments #
ndMAX is NetDocuments’ AI platform. It includes a suite of embedded AI applications that work directly within the NetDocuments interface, including auto-profiling, NDA analysis, contract risk analysis, judge analytics, and more. These are available through the ndMAX Studio. The Legal AI Assistant, including Smart Answers, is now available in Canada.
Smart Answers #
Smart Answers is the flagship capability of the Legal AI Assistant, and it became available to ndMAX customers starting March 31, 2026. Smart Answers lets you ask natural language questions and get conversational responses grounded in your firm’s own documents, complete with citations back to the source.
This is fundamentally different from asking a question in a general-purpose AI tool. When you ask Claude or ChatGPT a legal question without connecting it to your documents, you get an answer based on its general training data. Every firm gets the same generic answer. Smart Answers draws from your firm’s actual documents, matter history, and institutional knowledge.
For example, you could ask Smart Answers:
- “What limitation period did we use in the Smith v. Jones settlement agreement?”
- “Find me precedents for non-compete clauses in employment agreements we drafted for tech companies.”
- “What were the key terms in the last commercial lease we negotiated for a retail tenant?”
Smart Answers searches your cabinet, reads the relevant documents, and provides a plain-language answer with citations. No need to pre-load documents or know which file to open. For more on how search works in NetDocuments, see How to Search in NetDocuments: Basic and Advanced.
Smart Answers operates entirely within your existing NetDocuments permissions. It can only access documents the user has permission to see. Ethical walls, DLP rules, and access controls apply automatically. No document text, prompts, or AI responses are retained by NetDocuments or used to train models. Claude for Legal: AI with Secure Access to Your Documents #
In May 2026, Anthropic launched Claude for Legal, a major expansion of their AI platform specifically designed for the legal industry. This launch included over 20 MCP connectors to widely used legal systems (including NetDocuments), 12 practice-area plugins covering everything from contract review and M&A diligence to litigation support and regulatory compliance, and integrations with platforms like Thomson Reuters CoCounsel Legal, Westlaw, and Practical Law.
What Is MCP? #
MCP (Model Context Protocol) is an open standard that allows AI tools to connect securely to external data sources. Think of it as a secure bridge between Claude and your NetDocuments repository. With MCP, Claude can search your documents, retrieve content, and assist with drafting, all while your documents remain in NetDocuments. Nothing is downloaded, duplicated, or moved outside the platform.
How the NetDocuments MCP Connector Works #
The NetDocuments MCP connector is listed in the Anthropic marketplace and available to ndMAX Enterprise customers. When enabled, it allows Claude to:
- Search your NetDocuments repository by name, content, or profile fields
- Retrieve and read document content to answer questions or assist with analysis
- Draft new documents based on your firm’s precedents and templates
- Work across your matters, pulling context from multiple documents in a single request
Every MCP interaction runs against your existing NetDocuments credentials. Ethical walls, matter-level restrictions, and access controls apply automatically. Documents never leave the platform. Real-World Examples: Using Claude with NetDocuments via MCP #
Here are practical examples of how a lawyer might use Claude for Legal with the NetDocuments MCP connector:
Contract Review
You receive a draft commercial lease from opposing counsel. Instead of reading it line by line, you ask Claude to review it against your firm’s standard lease template stored in NetDocuments. Claude pulls your template via MCP, compares the two documents, and flags deviations, missing provisions, and unusual terms. You get a marked-up summary in minutes.
Precedent Research
A partner asks you to draft an employment agreement for a tech startup. You ask Claude to search your NetDocuments repository for similar agreements your firm has drafted in the past two years. Claude finds three relevant precedents, summarizes the key terms from each, and highlights which clauses varied between them. You start drafting with a clear picture of your firm’s approach.
Matter Summarization
You are picking up a file from a colleague who left the firm. The matter workspace has 200 documents. You ask Claude to summarize the key developments, identify the most recent correspondence, and list any outstanding deadlines or commitments. Claude reads across the workspace and gives you a narrative summary with citations to specific documents.
Due Diligence
Your team is running due diligence on an acquisition. You ask Claude to review all executed contracts in the target’s data room (stored in a NetDocuments CollabSpace) and flag any change of control provisions, assignment restrictions, or consent requirements. Claude works through the documents and produces a structured summary organized by contract.
Drafting from Precedent
You need to draft an NDA for a new client. You ask Claude to find your firm’s most recent NDA template in NetDocuments, adapt it for the specific situation (mutual NDA, two-year term, Canadian governing law), and produce a first draft. Claude pulls the template, makes the adjustments, and gives you a working draft to review.
Using Claude Without MCP: What You Need to Know #
Not every firm has MCP enabled, and not every user is on a Claude plan that includes it. You can still use Claude to assist with legal work, but there are important differences in how your data is handled.
Copying and Pasting Content into Claude #
Without MCP, the most common way to use Claude with your documents is to copy text from a document and paste it into a Claude conversation. Claude can then analyze, summarize, or help you draft based on that content.
This works, but there are trade-offs:
- You are manually moving content outside of NetDocuments and into Claude’s interface. The content is no longer governed by your NetDocuments permissions, ethical walls, or DLP rules.
- Claude does not have access to the rest of your repository. It can only work with what you paste into the conversation. It cannot cross-reference other documents, search for precedents, or pull context from related matters.
- Your firm’s security and compliance policies may restrict or prohibit copying confidential client content into external AI tools.
Data Retention by Plan #
How Claude handles your data depends on which plan you are using. This matters for firms evaluating the privacy implications of using AI with client-confidential information.
Claude Free and Pro (Consumer Plans)
- Conversations are stored until you delete them.
- Deleted conversations are removed from your interface immediately but remain in Anthropic’s backend systems for up to 30 days before permanent deletion.
- As of September 2025, consumer data is used for model training by default unless you have actively opted out. If you did not opt out, data may be retained in de-identified form for up to 5 years.
- Consumer plans are not HIPAA compliant and are not designed for handling sensitive client data at an enterprise level.
Claude API
- API log retention is 7 days by default (reduced from 30 days in September 2025).
- Data is never used for model training.
- Organizations can opt into 30-day retention if needed for auditing purposes.
Claude Enterprise
- SSO, SCIM, audit logs, and custom data retention policies are available.
- Zero Data Retention (ZDR) mode is available for qualifying customers, meaning data is not stored beyond immediate processing.
- Enterprise accounts can be configured for HIPAA compliance with a Business Associate Agreement (BAA).
- This is the tier designed for organizations handling confidential client information at scale.
Claude Enterprise with MCP and NetDocuments
- Documents remain in NetDocuments at all times. Claude connects to them via MCP but does not download or store copies.
- All NetDocuments governance, permissions, ethical walls, and audit controls remain in effect.
- Combined with Enterprise ZDR, this provides the highest level of data protection: no data retained by Claude, no documents leaving NetDocuments, full audit trail.
The Bottom Line on Data #
If you are using Claude on a consumer plan (Free or Pro) and pasting client-confidential content into conversations, that content is stored by Anthropic for up to 30 days, and for up to 5 years if you did not opt out of training at the September 2025 policy update. This is unlikely to meet your firm’s obligations around client confidentiality and data security.
If your firm is serious about using AI with client data, the recommended approach is Claude Enterprise with the NetDocuments MCP connector. Documents stay in NetDocuments, Claude connects securely, and with ZDR enabled, no data is retained by Anthropic beyond the immediate interaction.
ndMAX vs. Claude for Legal: Which Should You Use? #
They serve different purposes and can be used together:
ndMAX and Smart Answers
Best for quick, in-platform questions about your documents. No setup beyond enabling ndMAX. Works directly inside the NetDocuments interface. Ideal for searching across your repository, finding precedents, and getting citation-backed answers without leaving the DMS.
Claude for Legal with MCP
Best for complex, multi-step workflows that span multiple systems. Claude can connect to NetDocuments, Thomson Reuters, Westlaw, Microsoft 365, and other tools simultaneously. Ideal for contract review against templates, due diligence across large document sets, drafting from precedent, and workflows that require reasoning across multiple sources.
Firms that enable both have the most flexibility: Smart Answers for everyday questions inside the DMS, and Claude for deeper analysis and cross-system workflows.
